Terms & Conditions

1) General

a) In these conditions:

i) “CBGHANA” is the Pensions Fund Company assisting its customers secure cash loans or buy various assets on credit using their Tier 3 Funds as security for the loans.

ii) Consumer Bureau Limited (CB) is the manager of the platform and the relationship between all stakeholders.

iii) “The Platform” means cbghana.assetloangh.com. The cbghana.assetloangh.com, developed and managed by Consumer Bureau Limited (CB) in collaboration with CBGHANA, allows Customers of CBGHANA to apply for cash and asset loans from Financial Institutions in Ghana.

iv) "The Lender” means the Financial Institutions financing the cash or asset loans Customers of CBGHANA on the cbghana.assetloangh.com.

v) “The Customer” or “you” means the person who is applying for a cash or asset loan on the cbghana.assetloangh.com platform.

vi) “Stakeholders” means CBGHANA, Consumer Bureau Limited, The Lenders, Vendors and Customers who use or provide different services or assets to users of cbghana.assetloangh.com.

b) These conditions shall govern and form part of every contract for the financing of cash and / or asset loans on the cbghana.assetloangh.com platform. Any variation, cancellation or waiver of these conditions shall not be valid unless agreed in writing and signed by the CB in writing and no servant or agent of the Company other than a Director has the authority to vary these conditions.

c) No contract shall come into existence until the Customer's Application for a cash or asset loan is approved by a Lender.

2) Application and Processing

a) Interest rates and other Charges on Cash and Asset Loans vary depending on the Lender. Customers can preview the monthly repayments for the Cash Amount or Asset required by selecting the preferred Lender and Branch to guide its choice of Lender.

b) Customers are required to fill out the Cash or Asset Loan Application forms and attached Scanned and Readable Copies of the following documents:

i) Pay Slips for the last 3 months.

ii) Bank Statements for the last 3 Months.

iii) National ID.

iv) Completed Application form.

Please note that the Application would be deemed to be incomplete if any of the above documentation is not attached and submitted on cbghana.assetloangh.com.

c) All applications for Cash or Asset Loans shall be approved or rejected within 48 hours of such Application being submitted on cbghana.assetloangh.com.

d) The Customer shall be notified by SMS to the number indicated on the application when his / her Cash or Asset Loan Application is approved or rejected.

3) Repayments

a) Credit Periods for Cash and Asset Loans will be for a maximum tenure of 12 months.

b) Customers will be required to establish standing orders on their accounts for direct payments into the respective Lender Account before the disbursement of Cash Loans and / or delivery of items.

c) The start date for the repayment shall be 30 days from the date of the establishment of the standing order. If a Customer wishes for the payments to start later, he / she shall contact CB on the numbers provided to get a revised repayment amount that would factor in the new start date of the repayment.

d) If any of the monthly repayments are not done on the due dates, CB shall request CBGHANA to pay the amount and outstanding interest to the Lender.

4) Disbursement of Cash Loans

a) Upon and confirmation of the standing orders, Lenders shall disburse any loans directly into the customers account within 24 hours.

b) Actual time of crediting a Customers Account will depend on the Customer’s Bank.

5) Risk, Delivery and Performance of Assets

a) Delivery of Assets

i) Delivery times for assets procured on credit from the cbghana.assetloangh.com platform shall vary from 3 to 5 days from date of disbursement depending on the location selected by the client.

ii) Customers can opt to have CB deliver to their homes or other location at an extra cost if an agreement is reached with CB to do so.

iii) For building materials like Cement and Iron Rods, CB would specify a location within the town where the selected branch is located for the customer to pick up their items. Customers can also reach an agreement to have the items delivered to their sites at an extra cost if an agreement is reached with CB to do so.

iv) Customers will be required to sign a Waybill indicating that they have received the said items and that the items are not damaged. For sensitive electronic items like phones, LED TVs, and laptops, it is recommended that items are tested at the time of delivery to be sure that they were in perfect working condition at the time of delivery.

b) Defective Products, Warranties and Repairs

i) All the products listed on cbghana.assetloangh.com, apart from selected building materials, are covered under a manufacturer’s warranty for periods between 3 and 24 months depending on the type of product and the Vendor supplying the product. Customers are advised to check the warranty periods for the specific items that they are buying at the time of purchase.

ii) If any product supplied by CB to the customer is defective, the Customer is required to return it to the point of pickup, show proof of purchase of the item from cbghana.assetloangh.com and fill out a form clearly explaining the fault. CB would pickup the item on the next delivery date (which would usually be every week), send the item to the Vendor to have it repaired and returned to the pickup location for collection by the customer. If the issue is under warranty, then the faulty component in the item will be replaced at NO COST to the customer. However, if the fault is not covered under warranty, then the Customers would be required to pay for the cost of repair before it is sanctioned.

iii) Please note that issues relating to power supply and screen damages for mobile phones, LED TVs, Laptops and Computer Monitors ARE NOT COVERED by warranty.

c) Extent of Liability

i) Any defect resulting from wear and tear, accident, improper use by the Customer otherwise than in accordance with the instructions or advice of CB or the manufacturer of any goods or any neglect by the Customer.

ii) Any goods which have been adjusted, modified, or repaired otherwise than by the Vendor’s representative.

iii) Any technical recommendations, statements or advice supplied by any of CB 's servants or agents, not given in writing in response to a specific written request from the customer before the contract is made

6) Applicable Law

a) Ghanaian Law shall govern this Agreement.
